On 24 April 2020, our Partner, Sarah Kambali together with our Associate, Anis Mohd Sohaimi, both from the firm’s Syariah Estate Planning team spoke on “Syariah Estate Planning: Introduction to Faraid and Law of Inheritance for Muslims.” 

Anis explained that Faraid, or in other words, the law of succession, is a concept in Islamic Law which determines the distribution of a deceased’s property to heirs in proportions as set out in Al-Quran, Sunnah (sayings and practices of the Prophet, peace be upon him) and Ijma’ (consensus of Islamic scholars). Anis also covered the historical background of how faraid was introduced, the different categories of legal heirs, and the property which may be distributed according to faraid.

Sarah further explained the principles that are applicable in calculating the portions and demonstrated how such distribution would be calculated in given scenarios. Sarah further highlighted scenarios where some legal heirs may be impeded from inheriting a portion of the deceased’s property, especially on the ground of blood tie between the deceased and the legal heir.
